DMCA Policy (Digital Millennium Copyright Act)

1. Introduction

Flixtele ("Flixtele", "we", "us", "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website, we respond expeditiously to claims of copyright infringement reported to us.

Flixtele does not host, store, upload, archive, or distribute any media content. Our service acts solely as a technical platform that may reference or index content made available by third parties on the internet, over which we have no control. We respect the rights of copyright holders and are committed to addressing valid infringement claims.

Our general approach to copyright is also outlined in our Terms of Service.

2. Notification of Copyright Infringement

If you are a copyright owner, or authorized to act on behalf of one, and believe that copyrighted material is being used in a manner that constitutes infringement, you may submit a DMCA Notice of Alleged Infringement.

Upon receipt of a valid DMCA notice, Flixtele may take appropriate action at its sole discretion, including removing references to the challenged material or disabling access where applicable.

3. DMCA Notice of Alleged Infringement

Your DMCA notice must include the following information:

  • Identification of the copyrighted work claimed to have been infringed, or a representative list if multiple works are involved.
  • Identification of the allegedly infringing material and its location, including specific URLs or identifiers sufficient to allow us to locate the material.
  • Your name, company (if applicable), mailing address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information provided is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on their behalf.
  • Your full legal name and electronic or physical signature.

4. Counter-Notification Procedures

If you believe that material was removed or access disabled due to mistake or misidentification, you may submit a counter-notification in accordance with the DMCA.

Your counter-notification must include:

  • Your physical or electronic signature.
  • Identification of the material removed and the location where it appeared before removal.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed due to mistake or misidentification.
  • Your name, address, telephone number, email address, and consent to jurisdiction of the appropriate court.

We may forward a copy of the counter-notification to the original complaining party.

5. Repeat Infringers

Flixtele reserves the right, in appropriate circumstances, to suspend or terminate access for users who are repeat infringers, in accordance with our policies.

6. Disclaimer

Any person who knowingly misrepresents that material or activity is infringing may be subject to liability under applicable law, including damages and legal fees.
